1. Agreement to Terms

By accessing or using Fleeterzen ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Fleeterzen is operated by Mikhail Sankar trading as Fleeterzen ("we", "us", "our").

2. Description of Service

Fleeterzen is a cloud-based fleet management platform that enables logistics companies to manage drivers, vehicles, jobs, GPS tracking, invoicing, and reporting. The Service is provided on a subscription basis.

3. Account Registration

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Each company account may have one or more admin users and driver users. You are responsible for all users you add to your account.

4. Free Trial

We offer a 14-day free trial with usage limits (up to 5 drivers, 5 vehicles, and 30 jobs). No payment information is required during the trial. At the end of the trial period, your account will enter read-only mode until you subscribe to a paid plan.

5. Subscriptions and Payment

Paid subscriptions are billed monthly in advance. By subscribing, you authorise us to charge your payment method on a recurring monthly basis. Prices are as displayed on our pricing page and may be shown in various currencies depending on your location.

Subscription fees are non-refundable except as described in our Refund Policy. We reserve the right to change pricing with 30 days' notice to your registered email address.

6. Cancellation

You may cancel your subscription at any time. If you subscribed via Paystack, use the "Manage Subscription" link in the subscription confirmation email Paystack sent you after checkout. You can also cancel by contacting us at admin@fleeterzen.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date, after which your account will enter read-only mode.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Transmit harmful, fraudulent, or unlawful content
• Attempt to gain unauthorised access to any part of the Service
• Resell or sublicense the Service without our written consent
• Use the Service to track individuals without their knowledge or consent

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you input into the Service. We process your data only to provide and improve the Service.

9. Service Availability

We aim to provide reliable, uninterrupted access to the Service but do not guarantee 100% uptime. We may perform maintenance with or without notice. We are not liable for any losses arising from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Fleeterzen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct harmful to other users or the Service. You may delete your account at any time by contacting us.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
